The Current Situation of the Law Applicable on Traffic Accidents

Abstract

The European international private law is encountering the problem of triple-track regulation of the law applicable on the traffic accidents (Hague convention on the law applicable on traffic accidents of 1971, Rome II, national international private law of Denmark). The author of the article is analyzing the relationship between the Hague convention of 1971 and Rome II.

The author comes to conclusion that the best option will be creation of the new international treaty, which will lead to elimination of the recent unsuitable situation and to the unification of the determination of the law applicable on the traffic accidents.
