Abstract
The author compares the qualification of international passengers railway carriage in Convention concerning International Carriage by Rail (COTIF) and Regulation (EC) No. 1371/2007 of the European parliament and of the council. Problems, which can due to a different qualification occur, are demonstrated on a number of practical examples.
The author points out, that the EC legislation should in future settle these issues.
